This Privacy Policy applies to the website available at pathful.com and any website content, features, or functions (the "Website"), owned and operated by Pathful, Inc. ("Pathful," "we," or "us"). It describes how we collect, use, and disclose Personal Information from visitors to our Website, and your rights regarding that information.

This policy covers the Website only. A separate Services Privacy Policy governs our K–16 workforce readiness products. By accessing or using the Website, you acknowledge you've read and understood this policy — please also review our Terms & conditions.

1. Personal information we collect

If you engage with certain features on our Website — requesting a demo, signing up for training or webinars, or connecting with our customer support team — we'll ask you to provide Personal Information such as your first and last name, organization name and type, work email address, city, state, phone, and job title, along with any additional information you choose to provide. By providing a phone number you consent to be contacted by SMS text message (message and data rates may apply) — reply STOP to opt out.

2. A note about children

Our Website is intended for a general audience and not for children under age 13. We do not knowingly collect Personal Information from children under 13 via our Website. If we learn we've inadvertently done so, we'll take steps to promptly delete it.

3. Automatically collected information

We automatically collect certain information when you visit our Website, including your IP address, browser type and version, device operating system and language, country, the areas and pages you visit, and the time and duration of your visit ("Automatically Collected Information"). We use this to understand how our Website is used, diagnose technical problems, remember your preferences, improve security, and improve the Website's general functions. When this information identifies you as an individual, we treat it as Personal Information under this policy.

We use certain technologies to collect this information:

  • Cookies: small data files stored on your device that let us recognize your browser on return visits and remember your preferences.
  • Clicktracking: captures clickstream data about your use of the Website — what you see or click on, and how you move through certain features.

We use third parties to help us collect and understand the Automatically Collected Information described above. We do not serve targeted advertising on our Website. However, when you use the internet, we and various third parties — ad networks, web analytics companies, social networking platforms — may use tracking technologies to collect information about your online activity over time and across websites, including to measure ad effectiveness and target advertisements that may interest you. Our Website does not currently respond to "do not track" (DNT) browser signals. 5. How we use & disclose information

We do not sell Personal Information, and we do not engage in what state laws refer to as commercial "sharing" of Personal Information. We may use and disclose your Personal Information to:

  • Administer and maintain the Website, including to protect its security.
  • Communicate with you — respond to your requests, such as a product demo, notify you of Website changes, or ask for feedback.
  • Send you marketing information about products we believe might interest you.
  • Provide it to a new business owner in a reorganization, merger, sale, bankruptcy, or similar business change.
  • Prevent fraud or other unlawful use in the event of a known or suspected Terms of Use violation, including sharing with parties assisting an investigation, as required by law.
  • Meet a legal obligation, including to protect our rights or the rights and safety of others, or to comply with a court order or lawful regulatory request — where legally permitted, we'll direct the requester to you or attempt to notify you first.

6. Sharing with third parties

We rely on third parties for services like web hosting, data storage, security, analytics, content delivery, and non-marketing email communications, and it may be necessary to share your Personal Information with them to do that work. No mobile information is shared with third parties or affiliates for marketing or promotional purposes, and we do not share text-messaging opt-in/consent data with any third party.

7. Third-party links

Our Website links to third-party sites, including social networking sites, that may be prepared or operated by parties other than Pathful. Linking isn't an endorsement and doesn't imply affiliation — we don't control those sites or their privacy practices, and they may use their own tracking technologies. Review the privacy policy and terms of any site you visit.

8. Security

We've implemented physical, administrative, and technical safeguards to help protect the confidentiality, security, and integrity of your Personal Information. The internet isn't perfectly secure, though, and we aren't responsible for security breaches that aren't reasonably foreseeable or within our control.

9. How long we keep information

We keep your Personal Information for as long as needed for the purpose it was provided, or as long as applicable law permits — including to meet legal obligations, resolve disputes, enforce our agreements, and protect the Website's security. We may create and retain deidentified data for lawfully permissible purposes.

10. Opting out of marketing emails

We may send you emails about products and services we believe may interest you. Opt out anytime via the "unsubscribe" link at the bottom of any such email, or by contacting support@pathful.com.

11. Use outside the United States

Our Website is not intended for use by data subjects in the European Union — if that's you, please don't use our Website. If you choose to use our Website from a country or region with data laws that differ from U.S. law, you acknowledge you're transferring your personal information outside your home country or region and consent to that transfer.

12. Your rights

We'll take reasonable steps to let you access, review, update, rectify, or delete personal data we hold about you. Subject to applicable state law, you may have:

  • Right of access — to obtain access to your personal data.
  • Right to rectification — to erase or rectify inaccurate or incomplete data.
  • Right to erasure — to obtain deletion of your personal data in certain circumstances.
  • Right to portability — to move, copy, or transfer your personal data.
  • Right to restrict processing — to restrict or limit our use, disclosure, or processing of your personal data.

Subject to applicable law, you may also have the right to receive certain of your Personal Information in a structured, commonly used, machine-readable format, and to have it transmitted to another company where technically feasible.
